Understand the rules that govern your use of CursorClip.

Introduction

Welcome to CursorClip! These Terms of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Suryapratap Singh Rathore, operating as Team CursorClip (“we,” “us,” or “our”), concerning your access to and use of the CursorClip software and the cursorclip.com website (collectively, the “Services”).

By accessing or using our Services, you agree that you have read, understood, and are bound by all of these Terms. If you do not agree with all of these terms, you are expressly prohibited from using the services and must discontinue use immediately.

1. Our Services

CursorClip is a screen recording application for macOS designed to create professional screen recordings with an auto-zoom feature. The Services also include the ability to store and share your video recordings through shareable links. We are committed to providing a reliable service and aim to ensure continued access and support for all our users.

2. User Accounts

To use our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Purchases, Subscriptions, and Lifetime Deals

a. Payments: We offer both recurring subscriptions and a one-time purchase for a Lifetime Deal (“LTD”). By making a purchase, you agree to pay all charges at the prices then in effect. For subscriptions, you authorize us to charge your chosen payment provider, Dodo Payments, on a recurring basis until you cancel. For Lifetime Deals, you agree to a one-time charge at the price presented at the time of purchase.

b. Lifetime Deal Terms: A Lifetime Deal grants you access to the CursorClip application and associated Services. “Lifetime” refers to the lifetime of the CursorClip product, meaning for as long as we continue to offer and maintain the Services. The specific terms of your LTD, including the policy for receiving future software updates, will be described in the offer you purchase. Should we ever cease to operate the Services, we are not obligated to provide a refund for Lifetime Deal purchases.

c. Cancellation: You may cancel your recurring subscription at any time through your account settings. The cancellation will take effect at the end of your current paid term. Lifetime Deals are one-time purchases and do not require cancellation.

d. Fee Changes: For subscriptions, we reserve the right to change our fees. We will provide you with reasonable prior notice of any price changes.

e. Refund Policy: We offer a 14-day money-back guarantee on your initial purchase of either a subscription or a Lifetime Deal. If you are unsatisfied with our service for any reason, please contact us at support@cursorclip.com within 14 days of your purchase to request a refund. We may, in our sole discretion, extend this refund period on a case-by-case basis.

4. Intellectual Property Rights

a. Our Services: We are the owner of all intellectual property rights in our Services, including the software, source code, website design, text, and graphics, as well as the CursorClip name, trademarks, and logos. These are protected by copyright and other intellectual property laws.

b. Your Content: You retain full ownership of all video recordings and other content you create, upload, or share using our Services (“Your Content”). We do not claim any ownership rights over Your Content.

c. License to Us: To operate the Services, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and transmit Your Content solely for the purpose of providing and improving the Services, responding to your support requests, and making Your Content available to you and anyone you share it with.

5. User Conduct and Prohibited Activities

You may not use the Services for any illegal or unauthorized purpose. You agree not to:

  • Upload or share content that infringes on any third party’s intellectual property or privacy rights.
  • Transmit any viruses, worms, or other malicious software.
  • Attempt to reverse engineer, decompile, or otherwise discover the source code of our software.
  • Use the Services to harass, abuse, or harm another person.
  • Circumvent any security features of the Services.

6. User-Generated Content (Your Content)

You are solely responsible for Your Content and the consequences of storing or sharing it. We have no obligation to monitor Your Content, but we reserve the right to remove any content that we believe violates these Terms or is otherwise harmful, without prior notice.

7. Term and Termination

These Terms remain in full force and effect while you use the Services. We may terminate or suspend your account at any time, without notice, if we have a good reason to believe you have violated these Terms (for example, by using the Services for illegal activities). This is a protective measure for the service and its community.

Upon termination of your account for a violation, your right to use the Services will immediately cease. We will delete Your Content from our servers in accordance with our Privacy Policy.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

IN NO EVENT WILL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT OR LOST DATA, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

10. Governing Law and Dispute Resolution

These Terms and your use of the Services are governed by and construed in accordance with the laws of India. You agree that any legal action or proceeding arising out of or related to these Terms will be brought exclusively in the competent courts located in Indore, Madhya Pradesh, India.

11. Age Limitation

The Services are intended for users who are at least 18 years old. Users under the age of 18 but at least 13 years of age may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

12. Miscellaneous

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the “Last Updated” date of these Terms. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
